(وإن رآه) أي: العبد (سيده) يتجر فلم ينهه، لم يصر مأذونًا له (أو) رأى المميزَ (وليُّه يتجر فلم ينهه، لم يصر مأذونًا له) لأنه تصرُّف يفتقر إلى الإذن، فلم يقم السكوت مقامه، كما لو تصرف أحد الراهنين في الرهن، والآخر ساكت، وكتصرف الأجانب.
