(ولا يُسمع قوله) أي: الغريم (لوكيل غائب) في الاقتضاء منه: (احْلِفْ أن لك مطالبتي، أو) احْلِفْ (أنه) أي: الموكِّل (ما عزلك) لأنه طلب للحلف على البتِّ على نفي فعل الغير، فلا يلزم الإجابة إليه.
