(وإن أخذ) الوكيل في قبض دين (رهنًا، أساء) الوكيل؛ لعدم الإذن (ولم يضمن) الوكيل الرهن إذا تلف بلا تفريط؛ لأن صحيحه غير مضمون، ففاسده لا ضمان فيه.
