(وإن كانت تالفة أو تعذَّر ردُّها؛ فله) أي، لربِّها (تضمين من شاء منهما) أي: من الدافع والقابض، لأن الدافع ضمنها بالدفع, والقابض قبض ما لا يستحقه.
