(إلا أن يكون الدافع دفعها إلى الوكيل من غير تصديق، فيرجع) الدافع (على الوكيل) ذكره الشيخ تقي الدين وفاقًا؛ لكونه لم يقر بوكالته، ولم تثبت ببينته. قال: ومجرد التسليم ليس تصديقًا.
