(ومن أخبر بوكالةٍ، وظُنَّ صدقه) أي: صدق مخبره (تصرَّف) اعتمادًا على غلبة ظنه. (و) إذا تصرَّف وأنكر المخبر عنه (ضَمِن) الوكيل ما فات بتصرُّفه، إن لم تثبت وكالته؛ لتبين أنه تصرَّف بغير حق. [
