(وإذا ساقاه على وَدِيِّ نخلٍ) أي: صغاره (أو) ساقاه على (صغار شجر إلى مدة يحمل فيها غالبًا، بجُزء من الثمرة، صح) العقد؛ لأنه ليس فيه أكثر من أنَّ عَمَلَ العامل يكثُرُ، ونصيبه يقلُّ، وهذا لا يصنع صحتها، كما لو جُعل له جزء من ألف جزء.
