(وإن ظهر الشجرُ مُستحَقًّا بعد العمل، أخذه) أي: الشجر (ربُّه، و) أخذ (ثمرته) لأنه عين ماله (ولا حقَّ للعامل في ثمرته، ولا أُجرة له) على ربِّ الشجر؛ لأنه لم يأذن له في العمل
