(ويُعتبر) في مزارعة (معرفةُ جنس البَذْر، ولو تعدَّد) البَذْر (و) معرفة (قَدْره) أي: البذر، كالشجر في المساقاة؛ ولأنها معاقدة على عمل، فلم تجز على غير معلوم الجنس والقَدْر، كالإجارة (وفي "المغني": أو تقدير المكان) وتعيينه، أو بمساحته.
