(ولا تصح إجارة الأرض وشجر فيها لحَمْلها) أي: حمل الشجر، وهو ثمرها وورقها ونحوه، وحكاه أبو عبيد إجماعًا ، وجوَّزه ابن عقيل تبعًا للأرض ولو كان الشجر أكثر، واختاره الشيخ تقي الدين وصاحب "الفائق".
