(ولا يُشترط أن تلي المدة) أي: مدة الإجارة (العقدَ، فلو أجَره سنة خمس في سنة أربع، صح) العقد؛ لأنها مدة يجوز العقد عليها مع غيرها، فجاز العقد عليها مفردة كالتي تلي العقد
