(فإن كان في أحد الحزبين من لا يحسنه) أي: الرمي (بطل العقد فيه، وأُخرج من الحزب الآخر مثله) كالبيع إذا بطل في البعض، بطل فيما يقابله من الثمن (ولهم) أي: لكل حزب (الفسخ إن أحبوا) لتبعيض الصفقة في حقهم.
