(إلا أن يكون في شرطها) أي: المناضلة (استقبال ذلك، فالشرط أولى) بالاتباع؛ لدخولهم عليه (كما لو اتفقا على الرمي ليلًا) فإنه يُعمل بما اتفقا عليه.
