وإن شغل المغصوب بملكه: كحجر بنى عليه أو خيط خاط به ثوبه أو نحوه فإن بلى الخيط وأنكسر الحجر أو كان مكانه خشبة فتلفت لم يجب رده ووجبت قيمته

(عليه، أو خَيْطٍ خاط به ثوبه، أو نحوه، فإن بلي الخيط، وانكسر الحَجَر) بحيث لا ينتفع به، وإلا؛ رَدّه مع أرشه (أو كان مكانه خشبة، فتلفت) الخشبة (لم يجب رَدّه) لأنه صار مُستهلَكًا (ووجبت قيمته) كما لو أتلفه.
