(وإن أراد الغاصبُ قَلْعه) أي: قلع الغراس، أو البناء (ابتداء) من غير طلب من المالك (فله مَنْعُهُ) من القلع؛ لأنهما ملكه، فليس لغيره التصرُّف عليه بغير إذنه.
