(وإن اتفقا) أي: مالك الأرض ومالك الغراس، أو البناء (على تعويضه) أي: على أن يعوض رَبُّ الأرض رَبَّ الغراس، أو البناء (عنه، جاز) لأن الحق لا يعدوهما.
