(وما لا تصح إجارته) أي: لم تجرِ العادة بإجارته (كغنم، وشجر، وطير) ونحوه (مما لا منفعة له) تؤجر عادة (لم يلزمه) أي: الغاصب (له أجرة) لأن منافعه غير متقوَّمة، ولا يرد عليه صحة استئجار الغنم لدياس الزرع، والشجر لنشر الثياب؛ لندرة ذلك.
