(لا إن دفع) إنسان (مفتاحًا إلى لص) فسرق اللصُّ ما في الدار المدفوع مفتاحها إليه، فالضمان على اللص دون الدافع؛ لأن اللص مباشر، والدافع متسبب، وإحالة الحكم على المباشر أَولى من المتسبب.
