كشاف القناعal-Buhuti

(وإن اصطدمت سفينتان) واقفتان، أو مُصْعِدَتان، أو مُنحدِرتان (فغرقتا، ضَمِن كلُّ واحدٍ منهما) أي: من القيِّمين (سفينة الآخر، وما فيها) من نفس ومال (إن فرَّط) لأن التلف حصل بسبب فعليهما، فوجب على كلٍّ منهما ضمان ما تلف بسبب فعله، كالفارسين إذا اصطدما.
