(ولا) شُفعة أيضًا (فيما ليس بعقار كشجر) مفرَد (وحيوان، وبناء مفرَد) عن أرض (وجوهر، وسيف، ونحوها) كسفينة، وزرع وثمرة؛ لأن من شرط وجوبها أن يكون المبيع أرضًا؛ لأنها هي التي تبقى على الدوام، ويدوم ضررها
