فإن أخر الطلب مع إمكانه ولو جهلا باستحقاقها أو جهلا بأن التأخير مسقط لها ومثله لا يجهله سقطت:

(فإن أخَّر) الشريك (الطلبَ مع إمكانه) أي: الطلب (ولو جهلًا باستحقاقها) أي: الشُّفعة، سقطت؛ لأنه لا يُعذر بذلك، لعدم خفائه غالبًا (أو) أخَّر الطلب (جهلًا بأن التأخير مسقِط لها، ومثله لا يجهله، سقطت) شُفعته؛ لعدم عُذره
