(وحيث أخذها) أي: أخذ الوليُّ بالشُّفعة (مع الحظ) للمحجور عليه (ثبت الملك) في المشفوع (للصبي ونحوه) كالمجنون والسفيه (وليس له) أي: المحجور عليه (نقضه بعد البلوغ) أو العقل، أو الرُّشد، كسائر تصرُّفات الولي اللازمة.
