(فإن طلب) الشريكُ (أخذَ البعضِ) من المبيع (مع بقاء الكلِّ - أي (٢) : لم يتلف من المبيع شيء - سقطت شُفعته) لأن حق الأخذ إذا سقط بالترك في البعض، سقط في الكل، كعفوه عن بعض قَوَدٍ يستحقه.
