(فإن نما الشِّقصُ في يد الأول) قبل أخذ شريكيه (نماءً منفصلًا) بأن أخذ أجرته أو ثمرته (لم يُشارِك (١) فيه واحدٌ منهما) لأنه انفصل في ملكه، فأشبه ما لو انفصل في يد المشتري قبل الأخذ بالشُّفعة
