(ولو أوصى المشتري بالشِّقص، فإن أخذه الشَّفيعُ قبل القَبول، بطلت الوصية واستقرَّ الأخذ) للشفيع؛ لسبق حَقِّه على حقِّ الموصى له، والوصية قبل القَبول بعد الموت جائزة لا لازمة، فبطلت؛ لفوات الموصى به قبل لزومها.
