(وأيهما) أي: أيُّ الشخصين من الشفيع والمشتري (علم به) أي: بالعيب عند العقد أو قبله (لم يَرُدَّه) أي: الشقص المعيب، ولم يطالب بأرْشٍ؛ لأنه دخل على بصيرة.
