(فإن كان الشفيع أخذ بالشُّفعة) قبل التَّلَف (لم يكن لأحدٍ استرداده) أي: الشِّقص؛ لاستقرار ملك الشَّفيع عليه، ويغرم مشتريه لبائعه قيمة المبيع، ويأخذ من الشفيع بدل ما وقع عليه العقد، وتقدم في البيع .
