(ولا فرق في الوارث بين ذوي الرحم) أي: الأقارب الوارثين بفرض، أو تعصيب، أو رحم (والزوج، والمَولى) وهو المعتِق، وعصبته المتعصبون بأنفسهم (وبيت المال، فيأخذ الإمام بها) أي: بالشُّفعة، إذا لم يكن هناك وارث خاص يستغرق بفرض، أو تعصيبٍ، أو ردٍّ، أو رحمٍ.
