(وإن كان) المَوات (قد مُلِك بإحياء، ثم تُرك حتى دَثَر، وعاد مواتًا، لم يُملك بإحياء إن كان لمعصوم) لأن ملك المحيي أولًا لم يزل عنها بالترك، بدليل سائر الأملاك.
