(ولا يَملك مسلم) بالإحياء (ما) أي: مواتًا (أحياه من أرض كفار صولحوا على أنها) أي: الأرض (لهم، ولنا الخراج عليها) لأنهم صولحوا في بلادهم، فلا يجوز التعرُّض لشيء منها؛ لأن الموات تابع للبلد. ويفارق دار الحرب؛ لأنها على أصل الإباحة.
