ومن نزل وظيفة لزيد وهو لها أهل لم يتقرر غيره فيها فإن قرر هو وإلا فهي للنازل

(ومن نزل عن وظيفة) من إمامة، أو خطابة، أو تدريس، ونحوه (لزيد، وهو) أي: زيد (لها) أي: الوظيفة (أهلٌ، لم يتقرر غيره) فيها؛ لتعلُّق حقه بها. (فإن قُرِّرَ هو) أي: قرره من له الولاية كالناظر، تَمَّ الأمر له (وإلا) بأن لم يقرِّره من له ولاية التقرير (فهي) أي: الوظيفة (للنازل) لأنه لم يحصل منه رغبة مطلقة عن وظيفته.
