(وإن لم يُعيّنه) أي: الإنفاق عليه واقفٌ (وكان) الموقوف (ذا روح) كالرقيق والخيل (فـ) إنه يُنفق عليه (من غلته) لأن الوقف يقتضي تحبيس الأصل، وتسبيل منفعته، ولا يحصل ذلك إلا بالإنفاق عليه، فكان ذلك عن ضرورته.
