(وللناظر الاستدانة على الوقف بلا إذن حاكم) كسائر تصرُّفاته (لمصلحةٍ، كشرائه للوقف نسيئة، أو بنقد لم يعينه) لأن الناظر مؤتمَن مطلق التصرُّف، فالإذن والائتمان ثابتان.
