(وإن كانت ولايته) أي: الناظر (من واقف، وهو) أي: الناظر (فاسق) حال الولاية (أو عَدْلٌ فَفَسَقَ، صح) كونه ناظرًا (وضُم إليه أمينٌ) سواء كان أجنبيًّا، أو بعضَ الموقوف عليهم، جمعًا بين الحَقّين كما قدمته.
