(وإن شرط) الواقف (أن نصيب المُتوفَّى عن غير وَلَدٍ لمن في درجته، استحقَّه) أي: النصيب (أهل الدرجة وقت وفاته) عملًا بالشرط (وكذا من سيوجد منهم) لأنه من أهل الدرجة فالشرط منطبِقٌ عليه
