(وقال الشيخ (١) : إن عَلِم أن رَيعه يَفْضُل دائمًا وجب صرفه؛ لأن بقاءه فساد) له (وإعطاؤه) أي: المستحق (فوق ما قدَّره (٢) الواقف جائز) لأن تقديره لا يمنع استحقاقه.
