كشاف القناعal-Buhuti

(ولا تقتضي) الهبة (عوضًا، ولو مع عُرف، كأن يعطيه) أي: يعطي الأدنى أعلى منه (ليعاوضه، أو يقضي له حاجة) ولم يصرح له بذلك؛ لأن مدلول اللفظ انتفاء العوض، والقرينةُ لا تساويه، فلا يصح إعمالها، ولهذا لم نُلحِقه بالشرط.
