(وإن كان الأب غير مأمون) قَبِلَ الحكم الهبة للصغير ونحوه (أو) كان الأب (مجنونًا) قَبِلَ الحاكم الهبة لولده (أو) كان الأب قد مات، و (لا وصي له، قَبِلَ له الحاكم) لأنه وليه إذًا.
