(وإن كان الشيء يسيرًا لم تجرِ العادة بتفريقه، اختصَّ هو به) لأن الإعطاء صدر إليه، ولا قرينة تصرف عنه (ذكره الحارثي. والهبة من الصبي لغيره باطلة) لأنه محجور عليه
