(وله) أي: لمن ذكر من الأب، والأم، وغيرهما (التخصيص) لبعض أقاربه الذين يرثونه (بإذن الباقي) منهم؛ لأن العلة في تحريم التخصيص كونه يورث العداوة وقطيعة الرحم، وهي منتفية مع الإذن
