(الثاني: ألا يعطيه) الأب (لولدٍ آخر) فلا يتملَّك من مال ولده زيد، ليعطيه لولده عَمرو؛ لأنه ممنوع من تخصيص بعض ولده بالعطية من مال نفسه، فلأن يُمنع من تخصيصه بما أخذ من مال ولده الآخر أولى.
