(أَمَةً تخرج من الثلث حال العتق، لم يجز أن يتزوجها) لاحتمال ألا تخرج من الثلث عند الموت، فلا تعتق كلها (إلا أن يصحَّ) المريض (من مرضه) فيصح تزوجها ؛ لنفوذ العتق قطعًا
