(وإن قال) مريض: (إن أعتقتُ سعدًا فسعيد حُرٌّ) في حال إعتاقي، فالحكم سواء (أو) قال: إن أعتقتُ سعدًا (فسعيدٌ وعمرو حُرَّان في حال إعتاقي، فالحكم سواء) فيما تقدم من غير فوق؛ لجعله عتق سعد شرطًا لعتق سعيد وحده أو مع عمرو.
