(ولو قال: أنت حرٌّ آخر حياتي) ثم مات السيد (عَتَق ووَرِث) لسبق الحريةِ الإرثَ (وليس عتقه وصية له) أي: فلا يتوقف على إجازة الورثة؛ لأنه حال العتق غير وارث، وإنما يكون وارثًا بعد نفوذه.
