(ولو كان فيهم (٢) ذو رَحِم من الموصَى به، مثل أن يوصي بعبدٍ للفقراء، وأبوه) أي: العبد (فقير، لم يَعتِق عليه) لأن الملك لم يثبت لكل منهم إلا بالقبض.
