(ولو وصَّى لزيد، وللفقراء بثُلُثه، قُسِم) الثلث (بين زيد والفقراء نصفين، نصفه له) أي: لزيد (ونصفه للفقراء) لأنه قابل بينه وبينهم، فاستويا في قَدْر الاستحقاق، كما في قوله: لزيد وعمرو،

ولو قال: لزيد والفقراء والعلماء. فلزيد الثلث ولهما الثلثان لذلك.
