(وإن وصَّى له بثلث عبد، فاستُحِقَّ ثلثاه، فله) أي: الموصى له (ثلثه الباقي؛ إن خرج من الثلث) لأنه موصىً به خرج من الثلث، فاستحقَّه، كما لو كان معيَّنًا
