(وإن وصَّى له بثلث ثلاثة أعبُد، فاستُحِق اثنان، أو ماتا، فله ثلث) العبد (الباقي) لأنه لم يوصِ له منه بأكثر من ثلثه، وقد شرك بينه وبين ورثته في استحقاقه.
