(وإن كان معه) أي: العاصب (ذو فرض) واحد، أو أكثر (أخذ) العاصب (ما فضل عنه) لحديث: "ألحقُوا الفرائضَ بأهلها، فما بقي فلأوْلى رجُل ذكرٍ".
