(ولا يكون) المُشكِل (أبًا، ولا أمًّا، ولا جدًّا، ولا جدة) وإلا؛ لاتَّضحت ذكوريتُه أو أنوثيته (ولا) يكون المُشكل -أيضًا- (زوجًا ولا زوجة) لما يأتي في النكاح أنه لا يصح تزويجه مادام مُشكِلًا.
